Home/Terms and conditions of the SECA care program
§ 1. GENERAL PROVISIONS
These Terms and Conditions (hereinafter referred to as the Terms) define the rules, scope, and conditions of participation in the free extended commercial warranty program named SECA care (hereinafter referred to as the Program).
The Organizer of the Program is KN MOTO Nadolny sp.k., with its registered office in Dąbrowa, address: ul. Bukowska 50, 62-070 Dąbrowa, Poland, EU VAT ID: PL7831793952 (hereinafter referred to as the Organizer).
The Program is strictly aimed at consumers (individuals acting for purposes outside their trade, business, craft, or profession) residing within the territory of the European Union (hereinafter referred to as Participants).
Participation in the Program is entirely free of charge and voluntary.
Statutory Rights Notice: This Program provides a voluntary commercial guarantee. It operates independently of and does not exclude, limit, or suspend the legal rights of the Participant under EU statutory consumer conformity laws (pursuant to EU Directive 2019/771 and applicable local national implementations regarding statutory seller liability for lack of conformity).
§ 2. ELIGIBILITY AND PRODUCT REGISTRATION

b) Completion of the Product Registration process within 30 calendar days from the purchase date indicated on the proof of purchase.
To complete the registration, the Participant must provide:

Uploading a photo or scan of the proof of purchase is not required during initial registration – proof of purchase shall be provided by the Participant upon submitting a warranty claim.
Providing consent for marketing communications (newsletter) is completely optional and is not a condition for participating in the Program.
The Organizer will review the registration within 14 calendar days. Upon successful verification, a confirmation e-mail containing a unique Registration ID will be sent to the Participant’s e-mail address. If rejected, the Organizer will provide a clear, objective justification.
§ 3. SCOPE OF COVERAGE AND EXCLUSIONS
Under the Program, the Organizer grants the Participant a commercial guarantee for the proper functioning of the Covered Product for a total period of 5 years (60 months) starting from the date of purchase.
Sequential Claims Handling Structure:
a) Months 1 to 24 (Statutory Warranty Period): Claims regarding defects or non-conformity must be submitted directly to the Seller (the Authorized Dealer where the product was purchased) in accordance with applicable statutory consumer laws.
b) Months 25 to 60 (Extended Protection Period): Claims under this Program are processed directly by the Organizer in accordance with these Terms.
The Program covers manufacturing and material defects attributable solely to the manufacturer that manifest during normal and intended use of the Covered Product.
The Extended Protection does NOT cover:
a) Mechanical damage resulting from accidents, crashes, abrasion, impacts, or external force;
b) Natural wear and tear of materials or components over time (e.g., degradation of waterproof membranes, wear on zippers, hook-and-loop fasteners, or gradual fabric fading);
c) Damage caused by improper maintenance, cleaning contrary to care labels, or misuse;
d) Products modified, altered, or repaired by unauthorized third parties;
e) Comfort issues, incorrect sizing, or fit preferences chosen by the Participant.
If a manufacturing defect occurs during the extended coverage period (Months 25-60), the Participant must notify the Organizer in writing within 30 days from the date the defect was discovered.
a) The Registration ID or proof of purchase number;
b) A detailed description of the defect;
c) High-resolution photos or videos demonstrating the issue.
The claim evaluation procedure consists of two stages:
a) Stage I (Preliminary verification): The Organizer will perform a preliminary review of the claim within 14 days of its receipt in the system and inform the Participant via e-mail whether the claim is accepted, rejected, or if the Product needs to be shipped for physical inspection.
b) Stage II (Final determination): If physical inspection of the Product is required, the final warranty decision will be issued and communicated to the Participant within 30 days from the date the Product package is delivered to the Organizer’s service center.
If physical inspection is required, the Participant shall send the cleaned product to the Organizer’s designated European service center: KN MOTO Nadolny sp.k., ul. Bukowska 50, 62-070 Dąbrowa, Poland. The shipment must clearly state SECA care on the outer packaging (e.g., next to the recipient’s name or on the shipping label). Failure to include this label may delay package processing.
Cross-Border EU Shipping Terms:
a) For valid claims approved under this Program, the Organizer shall bear or reimburse reasonable return shipping costs within the European Union.
b) The Participant is responsible for providing a valid pickup address within the EU.
If a claim is approved, the Organizer will, at its sole discretion:
a) Repair the Covered Product free of charge to restore full functionality; OR
b) Replace the product with a new unit of equal specification if repair is impossible or disproportionately expensive; OR
c) Offer a commercial discount of up to 50% off the current Manufacturer’s Suggested Retail Price (MSRP) towards a replacement item from the Organizer’s current catalog, if the original product is no longer available or repairable.
§ 5. UNCLAIMED PRODUCTS AND DEPOSIT
If a claim is rejected or if the Participant fails to accept the returned product, the item will be returned to the Participant at their expense.
If a returned shipment is not accepted or picked up, the Organizer will notify the Participant via e-mail, setting an additional deadline of 30 calendar days to arrange collection.
Upon expiry of this additional deadline, the Organizer reserves the right to charge reasonable, documented storage fees in accordance with civil law principles.
§ 6. DATA PROTECTION (GDPR COMPLIANCE)
The Data Controller for personal data processed under this Program is the Organizer (KN MOTO Nadolny sp.k.).
Personal data is processed exclusively for the purpose of executing the Program agreement and handling guarantee claims (Art. 6(1)(b) GDPR) and establishing or defending legal claims (Art. 6(1)(f) GDPR).
The Participant retains all rights under the EU General Data Protection Regulation (GDPR), including the right to access, rectify, erase, or restrict the processing of their data. For full details, please review our Privacy Policy at www.secamoto.com.
§ 7. APPLICABLE LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of Poland, without prejudice to mandatory consumer protection provisions under the laws of the Participant’s EU country of residence.
Any disputes arising out of or in connection with this Program may be submitted to the competent national courts or resolved through out-of-court dispute mechanisms, such as national consumer arbitration bodies.
§ 8. FINAL PROVISIONS
These Terms are effective as of the date of publication on the Organizer’s website.
The Organizer reserves the right to amend these Terms or terminate the Program for objective reasons (e.g., changes in legislation or business operations).
Any amendments or termination of the Program shall not affect the rights already acquired by Participants who registered their products prior to the effective date of such changes.
